Consumer Terms & Conditions

These Terms & Conditions (“Terms”) apply to all sales of Goods by Tinsmiths of Ledbury Ltd (“we”, “us”, “our”) to consumers (“you”, “your”). By placing an order, you agree to these Terms.

1. Definitions

1.1 “Goods” means furnishing fabrics, domestic lighting, and any other products supplied by us.
1.2 “Contract” means the agreement between you and us for the sale and purchase of Goods, governed by these Terms.

2. Orders

2.1 Orders may be placed via our website or by telephone.
2.2 All orders are subject to acceptance by us.

3. Pricing & Payment

3.1 Prices are as shown on our website and include VAT unless otherwise stated.
3.2 Payment must be made in full at the time of order.
3.3 We reserve the right to correct pricing errors before dispatch.

4. Delivery

4.1 Delivery times are estimates and not guaranteed.
4.2 Risk in the Goods passes to you upon delivery. Title passes only once payment has been received in full.

5. Fabric & Material Particularities

5.1 Fabrics can appear differently depending on screen settings and lighting conditions. We strongly recommend that you request a sample before ordering.
5.2 Fabric is cut to your measurements and is therefore considered a bespoke product. Such fabric cannot be returned unless faulty.
5.3 Variations may occur between production batches. We cannot guarantee exact matches with previous orders or samples. Where a precise match is required, please request a stock cutting or sample for approval before ordering.
5.4 Orders placed without receipt of a sample, or batch cutting where colour or pattern match is critical, are at your risk.
5.5 Pattern repeat and fabric width may vary by up to ±2cm. Where critical, please confirm exact measurements before ordering.
5.6 Fabric must be inspected before cutting. Faulty cloth cannot be returned once cut.
5.7 You should check all items immediately on delivery and notify us within three (3) working days of any incorrect items, breakages, or damage.
5.8 All obvious faults or defects in the fabric must be reported to us within one (1) week of delivery.
5.9 It is your responsibility to ensure that your curtain maker, upholsterer, or other contractor has the correct fabric details and, where applicable, a batch cutting.

6. Cancellation Rights (Consumer Contracts Regulations 2013)

6.1 You have the right to cancel your order within fourteen (14) days of receiving the Goods, without giving a reason.
6.2 To exercise this right, you must notify us in writing (email or post).
6.3 Goods must be returned to us within fourteen (14) days of cancellation, at your expense, unless faulty.
6.4 Refunds will be processed within fourteen (14) days of receipt of the returned Goods.
6.5 Exclusions: Fabric cut to order, customised items, and specially treated products (including FR-treated fabric) cannot be cancelled or returned unless faulty.

7. Returns & Faulty Goods

7.1 In addition to your cancellation rights (see Clause 6), you are entitled to a repair, replacement, or refund if Goods are faulty, damaged, or not as described, in line with the Consumer Rights Act 2015.
7.2 Please check your Goods promptly on delivery and notify us within three (3) working days of any incorrect items, breakages, or damage, providing photographs where possible, so we can resolve matters quickly.
7.3 Obvious faults in fabric must be reported within one (1) week of delivery.
7.4 This clause does not affect your statutory rights.

8. Fire Retardancy (FR) Treatment

8.1 Unless expressly stated otherwise, our fabrics are not supplied with fire retardant (“FR”) treatment.
8.2 For certain applications, including upholstery or commercial/public use, additional FR treatment may be legally required. It is your responsibility to check the requirements for your intended use.
8.3 On request, we can arrange FR treatment before delivery. An additional charge will apply, and a certificate of treatment will be provided.
8.4 Once treated, fabric cannot be returned or cancelled unless faulty.

9. Product Suitability

9.1 All furnishing fabrics supplied are intended for domestic use unless otherwise specified.
9.2 Lighting products are supplied for domestic interior use unless otherwise stated.

10. Intellectual Property

10.1 All images, designs, product descriptions, and website content remain our intellectual property and may not be reproduced without our written permission.

11. Limitation of Liability

11.1 Our liability shall not exceed the purchase price of the Goods.
11.2 We shall not be liable for any indirect, consequential, or economic losses.

12. Governing Law

12.1 These Terms are governed by the laws of England and Wales.
12.2 The parties submit to the exclusive jurisdiction of the courts of England and Wales.
